Grading and Paving

of Streets

Authorizing and directing the grading and paving Market Street from Second Street to the Borough line; directing the Chief Burgess and Secretary to advertise for bids for said improvements, and providing for the costs and expenses of the same, and the issuing of Bonds in such sums as may be required not to exceed the amount of assessments laid.

Whereas, Market Street from Second Street to the borough line is in need of improvement.

And whereas, the Borough engineer and street committee have prepared plans and specifications for the improvement of same by grading and paving with reinforced concrete the said street between the points aforesaid.

Now therefore, be it ordained and enacted by the Borough of Bolivar, Westmoreland County, Pennsylvania in Council assembled and it is hereby ordained and enacted by the authority of the same.

Section I. That the plans and specifications prepared by the Street Committee and Borough engineer for the improvement of Market Street from Second Street to the Borough line by grading and paving the same with reinforced concrete, be and the same are hereby approved.

Section II. That Market Street from Second Street to the Borough line be and the same is hereby required to be graded and paved according to said plans and specification prepared by Borough engineer and street committee.

Section III. That the Chief Burgess and Secretary of Council, be said they hereby are authorized to advertise for proposals for grading and paving with reinforced concrete of the said street between the points foresaid and to execute and deliver for, and on behalf of the said Borough proper contracts and agreements for the making of the improvements upon such terms and with said contractors as the Council shall approve and direct by proper Resolution.

Section IV. That two thirds of the costs and expenses for the grading and paving of the said street between the points aforesaid, shall be assessed against and collected from the owners of the property bounding or abutting on said improvements by an equal assessment as in such case is provided for by Act of Assembly.

Section V. That the Borough engineer is hereby authorized and directed to estimate the assessments by the foot front of the real estate bounding or abutting on said improvement in accordance with the Act of Assembly in such cases made and provided.

Section VI. That in order to provide for the costs and expenses of said improvements, the Council of said Borough may from time to time issue bonds in such sums as may be required in all to an amount not exceeding the amount of the said assessments, said bonds shall bear the name of the said Market Street and shall rest alone for their security any payment upon such assessments and shall bear interest at the rate of five (5) percent per annum, payable semi-annually and shall be issued payable in five (5) years from the date of issue reserving the right however to redeem the same or any part, thereof at any interest date.

Section VII. All Ordinances or parts of Ordinances heretofore enacted inconsistent herewith, are hereby repealed.
