Defining Disorderly

Conduct for

Borough

Residents


Defining disorderly conduct and providing penalties for the violation thereof.

Be it ordained and enacted by the Burgess and Town council of the Borough and it is hereby enacted and ordained by the authority of the same, that disorderly conduct within the limits of the borough of Bolivar shall be and is hereby defined as any act, word or conduct causing or tending to cause a disturbance of the peace and good order of the Borough, or causing or tending to cause any danger, discomfort or annoyance to the inhabitants of the Borough or users of the Borough thoroughfares, and shall include loafing, fighting, drunkenness, vagrancy, begging, the making of unnecessary noises, profanity, or indecency, languages, reckless or careless driving, or any other use of vehicles by owners or occupants thereof as shall endanger the safety or interfere with the comfort and convenience of persons, using or residing on the thoroughfares of the Borough, all the foregoing offenses as coming within the definition of said disorderly conduct are hereby declared to be unlawful.

Any person or persons violating this Ordinance or causing or helping others to violate it shall be subject to a fine of from ten ($10.) dollars to twenty-five ($25.) dollars for such offense, and in default of paying said fine shall be committed to the Borough Lock Up (not in use) for a period not exceeding 30 days or both.

Ordained and enacted in council lawfully assembled in Borough of Bolivar County of Westmoreland, state of Pennsylvania this 4th day of May 1943.

Amendment to the Above Ordinance # 42

Change to last clause of this amendment has been changed to read:

Be it ordained and enacted by the Burgess and Town Council of the Borough of Bolivar, and it is hereby and ordained by the authority of the same, that disorderly conduct within the limits of the Borough of Bolivar shall be and is hereby defined as any act, word, or conduct causing or tendering to cause a disturbance of the peace and good order of the Borough, or causing or tendering to cause any danger, discomfort or annoyance to the inhabitants of the Borough or users of the Borough thoroughfares, and shall include loafing, fighting, drunkenness, vagrancy, begging, the making of unnecessary noises, profanity, or indecent language, reckless or careless driving, or any other use of vehicles by owners or occupants thereof as shall endanger the safety of interfere with the comfort and convenience of persons using or residing on the thoroughfares of the Borough, and the foregoing offenses as coming within the definition of said disorderly conduct are hereby declared to be unlawful.

Any person or persons violating this Ordinance or causing or helping others to violate it shall be subject to a fine of from ten ($10) dollars to twenty- five ($25.) dollars and costs for each offense and in default of paying said fine and costs shall be committed to the Westmoreland County Jail for a period not exceeding 30 days or both.
