Cleanliness in Town

Ordinance providing certain regulations necessary for the health and cleanliness of the Borough of Bolivar and prescribing penalties for the violation of this Ordinance.

Be it ordained and Enacted by the Council of the Borough of Bolivar, County of Westmoreland and State of Pennsylvania, and it hereby ordained and enacted by authority of the same.

Section I. No house refuse, offal, garbage, dead animals, decaying vegetable matter, or organic waster substance of any kind, shall be thrown on any street, road, ditch, gutter or public place or private lot within the limits of this Borough and no putrid or decaying animal or vegetable matter, shall be kept in any house, cellar or adjourning out building or grounds for more than twenty four hours.

Section II. Any person, firm or Corporation, who shall keep or suffer to remain on his, their, or its premises or upon any private property, under his, their, or its control any dead carcass, garbage offal, putrid meat, nauseous liquor or other offensive or unwholesome matter, or shall cast the same upon a vacant lot or piece of ground, belonging to any person, or to the Borough or any street, alley, within the Borough or so near the limits thereof, as to be offensive, the same is hereby declared to be a nuisance, and shall be removed accordingly, and the person offending shall forfeit and pay for each offense, besides the expense of removing the same, the sum of not less than $5.00 or more than $25.00 to be collected by the Burgess, in the same manner as other fines and penalties are collected.

Section III. No goods, wares, merchandise or any matter of any kind, shall be deposited on the streets, avenues or public ways of the Borough nearer than six feet to the inside of the curb line or curb, existing in front of said property fronting on said street, so that their shall be a full clearance of six feet between the curb and the goods, wares, merchandise etc, or the containers thereof, and for the violation of this section of this Ordinance upon conviction, thereof before the Burgess, the offender or offender's shall pay a penalty of not less than $5.00 or more than t$25.00 to be collected in the same manner as other fines and penalties are collected.

Section IV. The provisions of this Ordinance shall be severable if any of its provisions shall be held unconstitutional, the decision of the Court shall be held to unimpair any of the remaining provisions of the act. It is hereby declared as a legislative intent that this act would have been included therein.

Section V. All Ordinances or parts of Ordinances, inconsistent herewith, be and the same are hereby repealed.
